Bulunduğunuz yerdeki adliyeye gidip oradan ilgili mahkemesine gönderilmek üzere bir dilekçe yazmanız gerekir. Posta masrafı ve pul yatırıp ön bürodan havale alıp hukuk veya ceza birimine ön bürosuna götürüp vermeniz yeterlidir. Dava dilekçesi nasıl verilir?

Dilekçe hangi kurumu ilgilendiriyorsa ona hitap edilerek başlanmalıdır. Başlık ve konu eksiksiz olmalı ve sağ üst köşeye tarih atılmalıdır. Başlık tarihin alt kısmında yer almalı ve ardından metin yazılmalıdır. Dilekçeler yazım ve noktalama kurallarına uygun resmi bir dille olmalıdır.

Dilekçe yazmaya nasıl başlanır?

Adli dilekçeden kasıt, adli makamlara verilen ve çoğunlukla içerikleri yasalar tarafından belirlenmiş bulunan dilekçelerdir. Bunlar dava dilekçeleri, şikayet/itiraz dilekçeleri, davaya cevap dilekçeleri, ihtiyati tedbir dilekçeleri, duruşmadan vareste tutulma dilekçesi gibi dilekçelerdir.

Bir dava dilekçesi kişi tarafından bizatihî olarak, avukat aracılığı ile ya da adliye yakınında bulunan arzuhalciler tarafından hazırlanabilir. Önemli olan dava dilekçesinde açıklamalı, konunun özeti olarak, gerektiğinde ileri sürülen konuların ispatlanabilir nitelikte olmasıdır.

Dava dilekçesini kim yazar?

Talep sonucunun ayrı bir dilekçe ile açıklanması halinde; bu dilekçe ya dava formu ile birlikte ya da dava formunun tebliğinden itibaren on dört gün içerisinde davalıya tebliğ edilir. Dava formu davalıya tebliğ edildikten sonra davalı davayı kabul edebilir. Davayı kabul etmesi halinde davalı bir kabul formu hazırlar.

Iyi bir dilekçe nasıl yazılır?

Dilekçe yazımında ilk olarak sağ üst köşeye tarih atılmalıdır. Ardından başlık ve alt satırda metin yazılmalı, kurum hiyerarşisine uygun olarak da saygı sözü eklenmelidir. Tarih, ad, soyad, adres ve imza ise sağ alt köşeye yazılmalıdır. Son olarak varsa ek belgeler dilekçede belirtilmelidir.

Dava dilekçesinde bulunması gereken zorunlu unsurlar nelerdir?
