Kısas kavramı nedir?

Kısas İslam öncesi Arap toplumunda kabileler arasında süregiden savaşların çözümü için kullanılırdı. Kan döküldüğünde, kısas aşiret misillemesi şeklinde gerçekleşir, katil bulunamazsa yakın bir akraba öldürülebilir veya daha az onurlu bir ikame olarak kan bedeli alınırdı.

Kısas suçları nelerdir?

Kelime anlamı “eşitlik”, “denklik”, “bir fiile aynı şekilde karşılık verme” olan kısas, bir ceza hukuku terimi olarak kasten öldürme, yaralama ve sakat bırakma durumunda suç teşkil eden fiile denk bir ceza verilmesini ifade eder. Kısas cezası “cana can, göze göz, dişe diş” şeklinde formüle edilmiştir.


Kısas dinen caiz midir?

Kısas cezasını uygun ve gerekli gören bizzat Allah'tır. Kısasta tarafların tam tatmin olması söz konusudur. Kısas idam değildir, kendi şartları içinde değerlendirilecek bir cezadır. Beş günah için had (Allah'ın koyduğu ölçüler) cezası vardır.

Kısas kimlere uygulanır?

Kasten adam öldürme ve müessir fiil suçlarında suçlunun işlediği fiile denk bir ceza ile cezalandırılması. İşleyene cezaî müeyyide uygulanması öngörülmüş yasak fiil anlamında fıkıh ve hukuk terimi.

Kuranı Kerimde kısas var mı?
